Federal Labour Court in Germany Obliges all Employers to Record Time

According to the German Federal Labour Court, all employers are obliged to introduce a system to record the working time worked by employees.

On 13 September 2022, the German Federal Labour Court (BAG) ruled that all companies are now obliged to record the working time of their employees. The legislator must now determine, among other things, whether the recording is to be done electronically or by other means. Before this decision, this obligation only applied, for example, to the recording of overtime, Sunday work or in other specific cases.

According to the German Federal Labour Court, employers are obliged to introduce a system to record the working time worked by employees.

This ruling is in line with the European Court of Justice's requirement, already issued in 2019, that employers must create a system that effectively records the daily hours worked by employees.
